The class action case, currently in the news, against Morrisons following a major data breach has highlighted the need for all business’s to ensure they are GDPR compliant.
Matters surrounding data protection, and how to avoid staff accessing and leaking data, will become even more significant once the General Data Protection Regulations (GDPR) come in to force on 25 May 2018.
Once in place, organisations will have to report data breaches that are likely to result in a high risk to the rights and freedoms of individuals. This will have to be notified to the relevant supervisory authority, likely to be the Information Commissioner’s Office, and the individuals themselves within 72 hours of the organisation becoming aware of the breach. A failure to notify a breach when required could result in a significant fine of up to €10 million or 2 per cent of the organisation’s global annual turnover, whichever is higher.
